Premium Rate SMS Service

BY SENDING AN SMS TO THIS PREMIUM RATE SERVICE, YOU HEREBY ACCEPT AND AGREE TO ABIDE BY THE FOLLOWING TERMS AND CONDITIONS. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, PLEASE DO NOT USE THIS SERVICE. IN ADDITION, PLEASE REFER TO THE TERMS AND CONDITIONS OF YOUR APPROPRIATE MOBILE OPERATOR.

Access to the Service

You must be 16 years or older or have the bill payers permission in order to use the service. In order to use the Service, you must have the following:

  1. Mobile connection/communication subscription with the participating mobile carriers or have access to the communication network for which Qmani Pty Ltd or its associated companies makes the Service available;
  2. Pay for any service fees associated with the participating network access.

The Service

  1. Please check carrier for access as some users may be unable to access due to their mobile plan. As a guide, this service is available to:
    1. TELSTRA Customers;
    2. OPTUS Customers;
    3. VODAPHONE Customers;
    4. Hutchinson and 3 Mobile Customers;
    5. Virgin Mobile Customers;
    Qmani Pty Ltd does not warrant that this service will be available to customers as above.
  2. Qmani Pty Ltd will display the cost of using this service and we may change the prices for this service at any time without notice, unless otherwise notified. Such changes will not apply to any previous and ongoing orders. All prices include GST.
  3. Any transmission or delivery of content and/or data through this service may cause you to incur additional charges by the network operator. You shall be solely responsible for such charges and Qmani Pty Ltd bears no responsibility for the payment of any such charges.
  4. Qmani Pty Ltd shall in no event be liable should any of the content purchased by you fail to perform or be transmitted due to:
    1. phone not on;
    2. Mobile network failure;
    3. Mobile Users handling of content;
    4. Non-compatibility of phone model with content/service.

    NOTE:
    1. Delivery of Mobile Content is network and handset dependent.
    2. In any case of non-delivery not due to any of the reasons above, you will be entitled to a refund to the amount charged to by your Mobile Operator for that particular purchase.
  5. You must provide Qmani Pty Ltd with the information below to enable your refund without unnecessary delay:
    1. Full Name
    2. Full Address
    3. Mobile Number and Mobile Network
    4. Content Ordered
    5. Date and Time

  7. Qmani Pty Ltd will provide a customer service helpdesk available from 8.30am to 5.30pm AEST Monday to Friday. Our Service Consultants will be available to answer any queries or complaints you may have about this service.
  8. Qmani Pty Ltd total liabilities will be limited to the total value of the Purchase by you.
  9. Qmani Pty Ltd is not liable for your inability to send SMS and/or process any transactions due to transmission problems and assumes no liability for any data loss, delay in receiving or damage during the transmission of your ordered content. You agree that Qmani Pty Ltd has no responsibility or liability for the transmission of content by this service, other than stated above.
  10. Qmani Pty Ltd recognises that your privacy is very important. Qmani Pty Ltd aims to preserve your privacy at all times & we will not disclose your personal information to, or utilise your personal information with third party unless we are required to do so by law or we, in good faith, believe that such action is necessary to:
    1. Comply with the law or with legal process;
    2. Protect and defend our rights and property.
  11. Qmani Pty Ltd collects personal information in order to conduct the promotion or campaigns and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. Qmani Pty Ltd and/or its associates may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to Qmani Pty Ltd. All entries become the property of Qmani Pty Ltd and/or its associates where applicable.
